These general terms and conditions of sale expressly govern the commercial relations arising between the website owner (seller) and consumer users who, through this website (www.lafurgo.es) owned by Repot Experience, S.L (hereinafter La Furgo), purchase the products offered at any given time.

These general terms and conditions of sale have been drawn up in accordance with Law 34/2002 of 11 July on Information Society Services and Electronic Commerce (LSSI-CE), Law 7/1998 on General Contracting Conditions (LCGC), and Royal Legislative Decree 1/2007 of 16 November approving the revised text of the General Law for the Defence of Consumers and Users and other complementary laws (TRLGDCU).

La Furgo may unilaterally modify, at any time it deems appropriate, the configuration and content of these General Terms and Conditions of Sale.

3. Purpose of the website

To purchase products offered through this website, the user must meet the following requirements :

• Be a natural or legal person resident or domiciled in a territory to which we ship our products.
• If a natural person, must be over 18 years of age and have sufficient legal capacity to contract.

4. Products offered

La Furgo will publish, alongside the image of each product for sale on the website, the specific characteristics and applicable selling price.

La Furgo guarantees that the price of products will be the price in force on the day the purchase is finalised, regardless of the day the physical delivery of the order takes place.

Users may complete the purchase through this website in the following languages: Spanish, Catalan and English.

5. Product availability

All orders placed through this website are subject to product availability. If there are supply difficulties or items are out of stock, any amount paid by the user will be refunded.

6. Purchase system

Purchases made through this website must follow the established online purchase procedure. The user may browse the website and/or search for desired products. Once a product has been selected, it can be added to the shopping basket/cart for subsequent purchase.

To complete the purchase, the user must provide the personal data requested, indicate a payment method from those available, and proceed to payment through the payment gateway provided.

8.1 Client commitment and availability

The client commits to being available during the selected day and time slot to receive their order. If the client is unable to collect their order, they may authorise a third party to collect it, provided they have notified La Furgo’s customer service team on telephone 664316287 or at contact@lafurgo.es.

8.2 Delivery modification

If La Furgo cannot guarantee delivery during the client’s selected time slot, La Furgo commits to informing the client as soon as possible and offering an alternative available delivery slot.

9. Transfer of risk and ownership

The risk in the products passes to the client at the time of delivery. The client acquires ownership of the products upon receipt of full payment of all amounts due, including shipping costs.

10. Price and payment methods

10.1 Payment methods

Prices on the website include VAT (where applicable) but exclude shipping costs, which will be added to the total amount due.

10.2 Value added tax

In accordance with Article 68 of Law 37/1992 of 28 December on Value Added Tax (LIVA), the delivery of items will be considered to take place in the Spanish VAT territory if the delivery address is in Spanish territory, except for the Canary Islands, Ceuta and Melilla.

10.3 Container deposit

Product prices on the website do not include the deposit for containers/packaging required for their transport and storage.

11. Right of withdrawal

11.1 Period and method of withdrawal

If the client is contracting as a consumer and user, they have the right to withdraw from this contract within 14 calendar days without justification.

To exercise the right of withdrawal, the client may use the withdrawal form provided, or by any other means that allows a record to be kept of the exercise of this right (by post, email or through our telephone number).

In the event of withdrawal by the client, La Furgo will refund all payments received from the client, including delivery costs, without undue delay and in any case within a maximum of 14 calendar days from the date on which the client informs us of their decision to withdraw.

11.2 Exceptions to the right of withdrawal

The client may not be able to exercise the right of withdrawal for certain products in application of the exceptions set out in Article 103 of Royal Legislative Decree 1/2007:

• Products that cannot be returned for reasons of hygiene or health protection, if unsealed after delivery.
• Products that may deteriorate or expire rapidly.
• Goods made to the client’s specifications or clearly personalised.

12. Comunications

Applicable regulations require that part of the information or communications we send to clients be in writing. By using this website, the user accepts that most such communications with La Furgo will be electronic.

13. Partial invalidity

If any of the clauses contained in these General Terms and Conditions of Sale were declared null and void by a final decision of a competent authority, the remaining terms and conditions shall remain in force.
